Eviction

If you are renting or leasing real estate (usually a house, apartment, or other building) and you do not comply with the terms of the lease agreement, the landlord or rental company will likely go to court and ask the court to evict you. The landlord or his attorney would file a Forcible Eviction and Detainer warrant. One way to help stop this action and prevent being evicted, if you are behind on your rent, is to file a Chapter 13 bankruptcy. Most of the time, you can pay the past due rent over a period of time, along with continuing to pay your ongoing regular rent (to stay on good terms with the landlord). As long as you are making your bankruptcy payments and paying your ongoing rent on time each month going forward, you usually can remain in the property.
